SPRIBE has won an interim injunction in Brazil against Betnacional in a dispute over the rights to its Aviator game, setting an early precedent for intellectual property protection in the country’s newly regulated iGaming market.
The Court of Justice of Pernambuco (TJPE) granted the order against NSX Brasil S.A., the operator behind Betnacional, requiring it to immediately stop using the “AVIATOR” trademark, as well as any similar visual or audiovisual elements linked to SPRIBE’s product. The ruling includes daily fines for non-compliance and will remain in place until further court decisions or a final judgment. The court pointed to SPRIBE’s registered trademark with Brazil’s INPI as the basis for its exclusive rights.
The conflict between Betnacional and SPRIBE originated with Betnacional’s introduction, in 2025, of an Aviator game under the auspices of a new supplier, having previously partnered with SPRIBE since 2022. SPRIBE claims this new product is a “close copy” of their 2018 original crash game and represents an infringement of SPRIBE’s intellectual property rights.
Betnacional is one of the largest operators in Brazil’s regulated gaming market, powered by Flutter Entertainment and operating as a subsidiary of NSX Brasil. Betnacional continues to see strong performance with crash-style games across the market.
This case is being monitored closely throughout the gaming industry and reflects increasing conflicts regarding exclusivity arrangements between operators and suppliers as well as ownership issues related to game content. Both game developers and operators will learn from this case about the necessity for strong intellectual property rights protections within supplier contracts and that the IP enforcement process for game developers operating in emerging markets like Brazil is becoming increasingly effective.
The injunction granted to SPRIBE is only a temporary solution until additional legal actions can be taken but the resolution of this case may establish precedents for other similar cases as Brazil’s regulated gaming framework develops further.
